New Castle Man Arrested Following Alleged Felony Assault and Resisting Arrest Incident

NEW CASTLE, DEDelaware State Police have taken Brandon Ash, a 23-year-old resident of New Castle, into custody on allegations of felony assault and resisting arrest after an incident that unfolded on Monday morning.

The events began around 11:39 a.m. on October 28, 2024, when a trooper responded to reports of a potentially disabled black Ford Edge at the intersection of South Dupont Highway and Second Avenue. Upon arrival, the trooper discovered the vehicle stationary with its engine running and the driver slumped at the wheel. The driver, identified as Brandon Ash, regained consciousness as the officer checked on him and initially complied with instructions to exit the vehicle.

During the encounter, the trooper detected signs of impairment and a strong scent of marijuana emanating from the SUV. As additional troopers arrived at the scene, Ash allegedly ignored repeated verbal commands, pushing officers and attempting to re-enter the vehicle. In the ensuing struggle, Ash is accused of resisting arrest and attempting to seize a trooper’s Taser after it was deployed.

Following the altercation, Ash was subdued and transported to a local hospital for medical evaluation. Two troopers involved in the incident sustained minor injuries and were treated at a nearby medical facility.

Further investigation revealed that Ash’s driver’s license was suspended. A search of the SUV uncovered approximately 1.63 grams of marijuana. Once released from the hospital, Ash was taken to Troop 2, where he was charged with various offenses.

The charges against Ash include two counts of Assault 2nd Degree for injuring a law enforcement officer, removing or attempting to remove a deadly weapon from an officer, resisting arrest with force or violence, driving under the influence of drugs, disorderly conduct, and driving while suspended, along with other traffic violations. Ash was arraigned by Justice of the Peace Court 11 and remanded to Howard R. Young Correctional Institution on a $46,500 cash bond.

As with all legal proceedings, it is important to note that these charges are allegations, and Brandon Ash is presumed innocent until proven guilty in a court of law.
