STRATA Skin Sciences Secures Legal Victory Over LaserOptek in Marketing Dispute

HORSHAM, PASTRATA Skin Sciences, Inc. (NASDAQ: SSKN) has achieved a significant legal win as the United States District Court for the Eastern District of Pennsylvania ruled in favor of the company in its case against LaserOptek America Corp., Monarch Aesthetic Services, Inc., and The Pinnacle Health Group. The court order addresses unfair competition allegations related to the marketing and sales of LaserOptek’s Pallas lasers in the U.S.

Filed on August 19, 2024, STRATA’s complaint and motion for a preliminary injunction argued that the defendants engaged in deceptive marketing practices. The court’s decision, issued on November 8, 2024, prohibits LaserOptek and The Pinnacle Health Group from promoting Pallas lasers with claims of reimbursement eligibility under CPT Codes 96920-96922. Additionally, they are barred from disseminating false or misleading information about the Pallas lasers or STRATA’s products.

This court order follows a joint stipulation by the involved parties and partially resolves STRATA’s injunction motion. The company is resolute in pursuing further legal actions for both equitable and monetary relief.

Dr. Dolev Rafaeli, STRATA’s President and CEO, expressed satisfaction with the court’s decision, stating, “We are satisfied with this partial resolution of our preliminary injunction demands, as it saves both parties time and resources. We look forward to the outcome of the litigation, as we intend to vigorously defend users, patients and our own partner clinics from the damaging use of a non-excimer laser that seeks reimbursement under the CPT codes established over 20 years ago and re-affirmed for exclusive use of treatments with excimer lasers by the American Medical Association CPT board.”

Dr. Rafaeli emphasized the importance of protecting the integrity of STRATA’s products, intellectual property, and brand, as well as safeguarding clinical partners and the healthcare system from misleading practices. He noted the potential harm to patients and providers and highlighted the financial and reputational damages STRATA has incurred due to the defendants’ actions.

LaserOptek, a company based in Korea and listed on the KOSDAQ exchange, manufactures the Pallas line of laser medical devices. Pinnacle was involved in advising on the marketing and reimbursement strategies for the Pallas lasers in psoriasis treatments.

As the legal proceedings continue, STRATA stated that it remains committed to ensuring compliance and fairness in the medical device market, reinforcing its dedication to ethical standards and patient care.
