STRATA Skin Sciences Files Lawsuit Over Unfair Competition

HORSHAM, PASTRATA Skin Sciences, Inc. (NASDAQ: SSKN) has initiated legal proceedings against LaserOptek America Corp., Monarch Aesthetic Services, Inc., and The Pinnacle Health Group. The complaint, filed in the U.S. District Court for the Eastern District of Pennsylvania, accuses the defendants of unfair competition and false advertising in the marketing and sale of laser devices.

The core of the allegations centers around the Pallas laser devices, developed by Korean firm LaserOptek and distributed in the U.S. by Monarch Aesthetic Services. STRATA claims the defendants falsely advertised these devices as eligible for certain medical reimbursements reserved for excimer lasers, like STRATA’s XTRAC® devices. Furthermore, STRATA argues that the defendants made unsupported claims about the Pallas lasers’ performance and equivalence to its own products.

Dr. Dolev Rafaeli, President and CEO of STRATA, emphasized the importance of ethical billing practices, stating, “STRATA will protect the ethical billing and use of CMS reimbursable treatment codes for the benefit of our 4,000 partners.” He also highlighted concerns about the international sale of Pallas lasers, which, according to him, often results in customers returning to STRATA’s devices due to perceived instability and lack of efficacy.

The lawsuit seeks injunctive relief and damages, including the recovery of profits and legal costs. This legal action could significantly impact the dermatology market by addressing issues related to advertising and reimbursement practices. STRATA’s commitment to maintaining high ethical standards in medical device marketing is at the forefront of this case.
