LANCASTER, PA — In a shocking case that unfolded in Lancaster County, a 47-year-old man, Roberto Cruz-Aviles, was found guilty last Friday of strangling a woman while menacing her life. A resident of Lancaster City, Cruz-Aviles now faces a minimum mandatory sentence of ten years due to his status as a repeat offender.
Following a two-day jury trial before Lancaster County President Judge David Ashworth, Cruz-Aviles was found guilty of strangulation, a second-degree felony, and simple assault, a second-degree misdemeanor. The jury deliberated for over seven hours across two days before delivering the guilty verdict on Friday afternoon.
The brutal assault occurred on August 23, 2022, at a residence on Willow Valley Drive, West Lampeter Township. The prosecution presented evidence that Cruz-Aviles punched the victim, slammed her into a wall, and strangled her as she desperately tried to escape him. During the attack, he chillingly told her, “I’m going to kill you.”
The victim’s daughter witnessed the horrific assault, a fact which became a pivotal point during the trial. She testified about the traumatic incident, providing crucial evidence against Cruz-Aviles. The victim herself also took the stand, stating that seeing her daughter during the attack gave her the strength to fight off Cruz-Aviles.
Following the assault, the victim had visible strangulation marks on her neck. She was referred to the emergency department at a local hospital and subsequently required physical therapy due to her injuries.
When police arrived at the scene, Cruz-Aviles fled on foot but was soon detained for investigation. However, when informed of his arrest, he attempted to escape again, leading the police on a foot chase before he was finally apprehended and charged.
Assistant District Attorney Jaimes Spring prosecuted the case. In his closing arguments, he underscored the severity of the attack and the traumatic impact it had on both the victim and her daughter. His convincing presentation led to the guilty verdict.
Following the conviction, Judge Ashworth increased bail to $500,000 straight and remanded Cruz-Aviles to Lancaster County Prison. The defendant is now awaiting sentencing for his crimes.
West Lampeter Township Police Officer Rich Buck filed charges and testified during the trial, providing further evidence against Cruz-Aviles.
