HARRISBURG, PA — A federal grand jury indicted a York County man on November 29, 2023, for child pornography offenses. Michael Carbaugh, 37, is facing charges for allegedly distributing child pornography in early November and possessing it later in the month.
U.S. Attorney Gerard M. Karam stated that the indictment accuses Carbaugh of distributing child pornography from November 3 to 7, 2023, in York County. The indictment also alleges that Carbaugh was found in possession of child pornography on November 15, 2023.
The Federal Bureau of Investigation conducted the investigation into Carbaugh’s alleged activities. Special Assistant U.S. Attorney Erin Varley is prosecuting the case.
Under federal law, the total maximum penalty for these offenses could be up to 40 years of imprisonment, a term of up to lifetime supervised release following imprisonment, and a fine. Upon finding of guilt, the judge will impose a sentence considering the applicable federal sentencing statutes and the Federal Sentencing Guidelines.
It’s important to note that indictments are merely allegations. All persons charged are presumed innocent until proven guilty in court.
