HARRISBURG, PA — Attorney General Michelle Henry announced a settlement in a case against the owners of Split Rock Resort in Lake Harmony. The lawsuit accused the resort of mistreating timeshare consumers.
The settlement requires Split Rock Investments, LLC, and SCH USA, LLC, operating as “Bel Air Owner’s Circle,” to follow applicable laws. They must also fund a restitution pool of up to $250,000 for eligible consumers. Timeshare owners who feel mistreated should contact the Attorney General’s Bureau of Consumer Protection to seek restitution.
Last year, the Office of Attorney General filed a lawsuit claiming that Split Rock violated Pennsylvania’s Unfair Trade Practices and Consumer Protection Laws. The suit alleged that timeshare owners were denied access to the property and charged excessive maintenance and illegal usage fees.
“Consumers who paid hard-earned dollars for vacation accommodations were overcharged and denied access to their getaway resort,” Attorney General Henry said. “This settlement involves significant restitution funds for timeshare owners who did not get what they paid for.”
The settlement, in the form of a Consent Petition for Final Decree, has been filed with the Common Pleas Court of Carbon County. It is subject to court approval. Under the terms, Split Rock agreed to pay $5,000 in civil penalties and $50,000 in costs, in addition to the $250,000 restitution fund.
Defendants also agreed to refund consumers who paid resort fees for recreational facilities they did not use. The restitution funds are limited to $250,000 and are available for six months.
Timeshare owners who believe they qualify for a refund should contact the Bureau of Consumer Protection at 800-441-2555 or visit the Attorney General’s website for information on filing a complaint. The case was handled by Senior Deputy Attorney General Merna T. Hoffman.
This settlement aims to ensure that timeshare owners receive fair treatment and compensation for their losses.
