Mexican National Indicted for Illegal Reentry into the U.S., Faces Up to Ten Years in Prison

HARRISBURG, PA — A federal grand jury has indicted Pedro Millan-Montero, 36, of Mexico, on charges of illegal reentry into the United States by a previously deported alien. The indictment was announced on January 3, 2024, by United States Attorney Gerard M. Karam.

According to the indictment, Millan-Montero was first removed from the United States on June 15, 2012, through Hidalgo, Texas. Despite his removal, Millan-Montero allegedly returned to the U.S. without obtaining legal permission to do so. The indictment further alleges that he was encountered again within the country’s borders – this time in Lebanon County, Pennsylvania – on December 14, 2023.

Millan-Montero’s case highlights the continual efforts by federal law enforcement agencies to enforce immigration laws and tackle illegal reentry. The investigation was led by U.S. Immigration and Customs Enforcement and Removal Operations (ERO), with Assistant United States Attorney Michael Scalera prosecuting the case.

If found guilty, Millan-Montero could face severe penalties under federal law. The maximum penalty for this offense is ten years of imprisonment, followed by a term of supervised release, and a fine. Sentencing will be determined by the presiding judge after careful consideration of applicable federal sentencing statutes and the Federal Sentencing Guidelines.

However, it’s important to note that an indictment is merely an allegation. All persons charged are presumed to be innocent unless and until proven guilty in court.
