ACLU, Education Law Center Push Back Against Federal Threat to Diversity Programs

PHILADELPHIA, PA — The American Civil Liberties Union of Pennsylvania and the Education Law Center-PA have issued a firm response to a U.S. Department of Education warning, which suggested schools that maintain diversity, equity, and inclusion (DEI) policies could risk losing federal funding. The two organizations, through a letter addressed to Pennsylvania school districts and charter schools, underscored the legitimacy of such programs and warned of legal consequences should schools bow to these federal demands.

The letter argues that most DEI initiatives in schools are not only legal but integral under existing state and federal law, as well as constitutional principles. Efforts to dismantle diversity programs might even violate nondiscrimination mandates and the First Amendment, the letter states. It further clarifies that curriculum oversight falls under the jurisdiction of state and local authorities, rendering federal threats largely ineffectual.

“If Pennsylvania school administrators were to cave to the Department of Education’s vague demand to end any programs that promote diversity, equity, and inclusion, the chances of such a move ending in a costly nondiscrimination lawsuit are high,” said Stephen Loney, senior supervising attorney for the ACLU of Pennsylvania.

The Education Law Center-PA reinforced this position, with senior attorney Kristina Moon cautioning against the government’s efforts to vilify DEI, warning that such rhetoric disconnects from the majority of parental views. “Parents value learning environments that support students and provide opportunities for them to interact and learn from people with different experiences,” she stated.

Both organizations emphasized that DEI policies protect vulnerable student populations, including students with disabilities, LGBTQ+ youth, multilingual learners, and students of color, against systemic discrimination.
