Game-Changer for Women’s Rights! Education Department Rejects Biden’s Rewrite, Restores Title IX Protections

WASHINGTON, D.C. — On Friday, the U.S. Department of Education announced its decision to reinstate the Trump Administration’s 2020 Title IX Rule. The announcement marks a return to enforcing protections based on biological sex, following a legal challenge that deemed the Biden Administration’s 2024 Title IX rewrite unlawful.

The court ruling, issued by the United States District Court for the Eastern District of Kentucky, determined that the Biden administration’s attempt to expand Title IX protections to explicitly include gender identity was an overreach of regulatory authority. With the 2024 rewrite invalidated, the Department of Education will now refocus on Title IX’s original framework, which forbids sex-based discrimination in federally funded educational programs and activities.

Craig Trainor, Acting Assistant Secretary for Civil Rights, emphasized the shift in priorities. “The Biden Administration’s failed attempt to rewrite Title IX was an unlawful abuse of regulatory power and an egregious slight to women and girls. Under the Trump Administration, the Education Department will champion equal opportunity for all Americans, including women and girls, by protecting their right to safe and separate facilities and activities in schools, colleges, and universities,” he said.

The reinstated 2020 Title IX Rule aims to fortify the rights of individuals during campus disciplinary proceedings by enhancing due process protections. It also aims to safeguard campus free speech. Institutions are expected to maintain clear procedures for addressing Title IX complaints while ensuring fair treatment for all parties involved. These measures respond to concerns voiced during previous administrations over vague policies and alleged infringements on students’ rights.
