HARRISBURG, PA — Pennsylvania has taken a significant step towards modernizing family law proceedings with Governor Josh Shapiro’s signing of House Bill 917 into law. Championed by State Representative Melissa Shusterman, D-Chester, the legislation introduces the Uniform Family Law Arbitration Act, offering families a voluntary and private method for resolving legal disputes through arbitration.

The bill garnered unanimous, bipartisan support throughout its legislative journey, reflecting a shared consensus on the need for alternatives to traditional courtroom battles. Initially considered by the House last year, the bill successfully passed through both the House and Senate with unanimous concurrence, underscoring its broad acceptance among lawmakers.

The Uniform Family Law Arbitration Act aims to mitigate the adversarial nature of traditional court proceedings, which can often be financially and emotionally burdensome. “Resolving family law disputes through court proceedings can be a bitter and financially ruinous process,” stated Shusterman. The new law is expected to offer a more equitable platform, potentially reducing the power imbalance often seen in legal battles where one party may have greater financial resources and access to superior legal representation.

Notably, the arbitration process could prove particularly beneficial in cases involving domestic violence. By facilitating quicker resolutions, the law seeks to prevent prolonged exposure to stressful legal confrontations and protect the welfare of children caught in the middle of such disputes.

Representative Shusterman expressed gratitude towards her co-sponsor, Representative Tina Davis, D-Bucks, and her colleagues in both legislative chambers for their steadfast support, which was crucial in ensuring the bill’s enactment ahead of the legislative session’s conclusion.
