Senate Resolution on Removing Buy American Standards for EV Chargers Passes Despite Opposition

In a recent move that has sparked a significant debate about the future of electric vehicle (EV) charger manufacturing in the United States, the U.S. Senate voted this week to pass a resolution introduced by Senator Marco Rubio (R-Fla.). The resolution, which narrowly passed with a 50 to 48 vote margin, seeks to effectively eliminate Buy American standards for EV chargers.

This resolution implies that EV chargers funded by taxpayer dollars would no longer be required to meet any U.S. manufacturing or Buy America content value requirements. Notably, several Democrats joined Republicans in voting in favor of the resolution.

Unions including the AFL-CIO, International Brotherhood of Electrical Workers, and United Steel Workers have voiced their opposition to this resolution. Additionally, the BlueGreen Alliance, League of Conservation Voters, and the Alliance of American Manufacturing are also against the resolution, recognizing the potential implications it could have on American workers and industries.

U.S. Senator Bob Casey (D-PA) was among those who voted against the resolution. He stated, “By forever hindering our Nation’s ability to become less reliant on Chinese manufacturing of EV chargers, this resolution would do irreparable damage to American workers and manufacturing. Because of our domestic EV charging industry, America has the opportunity to become a world leader in the technology of the future. This cynical political ploy would force us to squander that opportunity.”

Earlier this year, the Federal Highway Administration (FHWA) issued a temporary public interest waiver to phase in Buy America requirements for EV chargers. This move effectively removed EV chargers from the long-standing Manufactured Products General Waiver, allowing EV charging infrastructure projects to proceed immediately. The newly passed resolution disapproves of this waiver, potentially preventing the FHWA from removing EV chargers from the general manufactured products waiver in the future. This could result in permanently weakening Buy America standards for clean vehicle charging infrastructure.

Despite the Senate’s decision, the Biden administration has pledged to veto the bill, indicating a potential standoff between lawmakers and the White House over the future of EV charger manufacturing in the United States.

The passing of this resolution underscores the growing tension and debate surrounding the role of American manufacturing in the rapidly expanding electric vehicle market. With the increasing global demand for EV chargers, the impact of this resolution on American workers, industries, and the country’s standing in the global EV market will be closely watched.
