Pennsylvania Attorney General Sues Home Improvement Company for Fraud

HARRISBURG, PA — Attorney General Michelle Henry has filed a lawsuit against Brothers All Around Service, LLC, and its owner, John McDonald. The Allegheny County home improvement firm is accused of using illegal contracts and failing to complete jobs or provide refunds.

The Office of Attorney General acted after receiving complaints from several consumers. These consumers had paid Brothers large upfront sums for jobs that were not completed. In some instances, the company did not issue refunds and avoided consumer phone calls.

The lawsuit states that Brothers’ contracts did not comply with the Pennsylvania Unfair Trade Practices and Consumer Protection Law or the Pennsylvania Home Improvement Consumer Protection Act (HICPA).

“This home improvement company demanded, and took, large upfront payments from customers, then failed to complete the work and had the audacity to actively avoid consumers who called for status updates,” said Attorney General Henry. “My office will continue to champion for consumers who are victimized by shady home improvement contractors that skirt the law.”

Many consumers gave Brothers large amounts of money upfront for room remodels or other significant home improvement projects. Most were left with unfinished work and had to hire other contractors to complete the jobs. In some cases, they also had to repair the work started by Brothers.

Some consumers found their phone numbers blocked by Brothers, making it impossible to get updates on their home improvement projects.

The lawsuit seeks to have the court declare Brothers All Around Service and McDonald in violation of the Consumer Protection Law and HICPA. It also demands that they pay restitution to impacted consumers and be barred from registering as home improvement contractors in the future.

Deputy Attorney General Francesca Miller-Surman filed the lawsuit in the Allegheny County Court of Common Pleas.
