Guatemalan National Faces Federal Charges for Alleged Illegal Reentry

HARRISBURG, PA — The United States Attorney’s Office for the Middle District of Pennsylvania has announced that 29-year-old Oseas Froilan Gomez-Tebalan, a citizen of Guatemala, was indicted Wednesday by a federal grand jury on charges of illegal reentry into the United States.

United States Attorney Gerard M. Karam detailed that the indictment accuses Gomez-Tebalan of having been previously removed from the country on March 18, 2017, through Phoenix, Arizona. It is further alleged that he was found in Franklin County, Pennsylvania, on March 21, 2024, without legal authorization to enter or remain in the United States.

This case falls under the jurisdiction of the United States Immigration and Customs Enforcement and Removal Operations, signifying the government’s ongoing efforts to enforce immigration laws. Assistant United States Attorney K. Wesley Mishoe is leading the prosecution, emphasizing the seriousness with which the federal system approaches cases of illegal reentry.

The legal proceedings highlight the potential consequences of such charges, including a maximum penalty of up to 20 years of imprisonment, along with three years of supervised release, various fines, and a special assessment. Sentencing, should there be a conviction, will be determined based on the federal sentencing statutes and guidelines, which aim to ensure fair and consistent outcomes across similar cases.

It is essential to note that an indictment is a formal accusation, not evidence of guilt. Oseas Froilan Gomez-Tebalan, like all individuals accused of a crime, is presumed innocent until proven guilty in a court of law.
